A question about surrogate mothers...?

Can people only get them if they can't conceive or can anyone have them. I was just watching an old episode of desperate housewives, where Gabi states she doesn't want to ruin her body, so her and Carlos decide to get a surrogate mother. I would have thought only couples that can't conceive would have been allowed surrogates so now I'm confused =(
