A surrogate mother is a woman who carries a baby for a couple who usually have fertility problems and can not conceive on there own. I am not pregnant or planning on using a surrogate mother but I was wondering what happens after birth if the surrogate mother does not want to give the child to the parents who hired her.Does a surrogate mother have to surrender the baby?
It becomes one hell of a sticky legal mess - its happened before!
Legally she's not bound by the contract that's been signed - but it doesn't always play out the way its suppose too!
IF the surrogate used her OWN egg then biologically the child IS half her's
ETA - Here's a case in the UK where the surrogate used her OWN egg and got to keep custody of said baby!

If the surrogacy is done properly there will be legal paper work signed in the agreement that she must hand over the baby. If not then she would face kidnapping charges and possibly more. Since the child is not biologically hers she has no right to it unless otherwise agreed.Does a surrogate mother have to surrender the baby?
well a surrogate mother is not the babies biological mother. They use the parents egg and sperm ..and the surrogates body..She has no rights to the child because she has to sign alot of paper work in the beginning to prevent such a thing
