Reasons why surrogate motherhood laws should be banned by the USA government?

In which forms surrogate mothers can be exploited by the intended parents?



I'm writing a research paper.Reasons why surrogate motherhood laws should be banned by the USA government?
It shouldn't, and that's what contracts and lawyers are for. How would a surrogate be exploited anyways, I can see the surrogate exploiting the intended parents and not turning over the child but then they could sue for the money they spent on her and the child
Here is an example.



"Jenny" works a low end job with no benefits or hopes for much advancement. So Jenny decides to be a surrogate mother even though she can't afford to have a baby let alone raise it.



In exchange for being a surrogate mom, the future adoptive parents pay Jenny $2,000 per month while she is pregnant. They pay all of her medical bills. Jenny's rent is also paid by the future parents.



When Jenny is 36 weeks along she knows giving this baby up will be extemely hard for her. She feels guilty about taking the $2,000 per month plus the other money. But she has no way to pay that all back. She also knows she can't afford to have a baby and raise it. So Jenny feels "pressured" to give her baby up even though the adoptive parents have never ever applied any pressure to her.



Now next scenario but still the same example:



Katie is a stay at home mom. She has 3 children. Her husband earns a good living that allows the family to thrive. Katie decides to become a surrogate mom. Like Jenny she is paid the same amount of money and covered medical bills plus rent.



At 36 weeks Katie too is having regrets. But, Katie and her husband can afford to pay back all of that money. They can afford to have another child.



So the question is this:



If you are propsective user of of surrogate mom do you want a Jenny type woman to carry your baby or Katie type woman? You want a baby. You want one real bad. You have the money to lay out. Do you want to risk it on a woman who doesn't need your money and is able to change her mind and do right by the baby?



Now you get what exploitation can be.



One more example and it is quick one.



Janet is 18 and decides to be a surrogate mom by her older cousin. Legally Janet is an adult. But she has a lot to learn in life and most 18 year olds do. Janet hasn't lived long enough to really understand the full gravity of many choices. When Janet is 36 weeks along, she wonders if she is doing the right thing. She has exteme doubt.



Carolyn is 32. Carolyn is asked by her best friend to be a surrogate mom. While she is flattered by the request, Carolyn knows she can't be a surrogate mom. She doesn't have it in her mentally to carry a baby and give it up even for her best friend. Carolyn politely turns her best friend down.



So the question is? Do you want to ask a Janet or Carolyn to be a surrogate mom? You don't want to hear the word No.

well in this age of suing based on genetic i'm sure there is some way somebody could sue and claim there child was predisposed to gene X because ms X, the surrogate mother also had gene X. Judges don't fully understand genetics and alot of crazy-unrealistic judgements have been made about them in recent years.
There really isn't any reason to outlaw surrogacy. However, a limit on the number of children a person has might be a good idea.... we have WAY too many rugrats out there who aren't cared for (even by their birth parents).
