Is being a surrogate mother legal in Canada?
I know its legal but is it legal to get payed for doing it?
And if its illegal in Canada what about if you deliver in the US? would that be against the law?
Or is it only legal to do it out of the goodness of your heart? Is being a surrogate mother legal in canada?
Surrogacy for pay is prohibited by the Assisted Human Reproduction Act.
I'm not sure what delivery would have to do with it. It's the payment for surrogacy that's prohibited, not the place of delivery. Are you going to be paid in American dollars, by an American couple, into an American bank account? If so, you don't have much to worry about.
Otherwise, worry. The surrogacy offense under AHRA is subject to a half-million dollar fine AND imprisonment of up to 10 years. You can ONLY be a surrogate out of the goodness of your heart in Canada, which is why it's typically done by family members, or by women outside of Canada. Is being a surrogate mother legal in canada?
To be perfectly honest the only thing I would pay for if I had a surrogate is medical bills. Any other pay is just selfish. You would be choosing to be a surrogate so you should choose to take on the responsibility of clothing and things like that.
In many States, paying for anything other than the delivery and medical bills is also illegal.
